you bind it using a spell, at first. eventually, Voldemorts soul was just so diminished that broke and bound itself to things of it's own accord. at least that's what i believe. as to binding the souls of people you murder, no, thats not how it works. when you murder your going against nature and your own soul splits in two and if you wish, you can bind part of it to another object.

The thing about Horcruxes are they are very complex and confusing magic. They are lightly touched upon in the books and nobody goes into real detail about it's grey area.
From what I infer from the book, when a person murders another, the murder soul is ripped in half. I assume that the murder will then use a spell to take that ripped portion of his or her soul and incase it in object, animal or person. Then again considering what happened to Harry, it could also be that the ripped soul will try and latch itself onto the first thing it 'sees'. In the Potters situation it was Harry and so on and so forth.
Hope that helps somewhat!
Cheers,

In those very long and tedious sessions in Dumbledore's office in HBP, it's said that 'murder rips your soul apart'.
How to actually make a Horcrux is uncertain. This would be a good topic for Chamber of Secrets. . .

In the pensieve Harry sees a young Tom Riddle asks Prof. Slughorn the same thing. Prof. Slughorn shakes his head an says that there is an incantation, but he doesn't know it.
By murdering others, Voldemort also rips apart his own soul- the souls of the people he murdered vanish (go to heaven, whatever you like), but it is the shattered pieces of himself that he binds to the items. Of course, one has to keep part of one's soul in their original body, or else that would be suicide. (Prof. Dumbledore mentions that the 7th horcrux is Voldemort himself, as he must keep at least one piece of his soul in his body).
I wondered about this too at first, good question.
